The District Application for Review and the Expedited Review Policy have been updated for 2016

The Montgomery County Conservation District has revised its Application for Chapter 102 and/or NPDES Permit Review to clarify a few items and add some minor revisions.  The changes become effective on January 1st, 2016.  The plan review fees remain unchanged.  The expedited plan review policy has also been revised.    Both documents are available here.

DEP to hold webinar to discuss the implementation of Act 162

The Department of Environmental Protection (DEP) announced that it will hold a webinar at 11 a.m. on Wednesday, Dec. 17, to discuss the implementation of Act 162.

On Oct. 23, 2014, Governor Tom Corbett signed H.B. 1565 into law, creating Act 162. The act changes what projects are subject to the mandatory riparian buffer requirements in Chapter 102. The webinar will provide an overview of DEP’s proposed implementation of the act, including buffer equivalency demonstrations and offsetting guidance.

The webinar is geared toward, but not limited to, county conservation districts, developers, transportation engineers and mining operators.

Act 162 will go into effect on Dec. 21. DEP plans to issue interim technical guidance related to the equivalency demonstration and the offsetting guidance in advance of the effective date. These guidance documents will concurrently go through the public participation process.

Changes To MCCD Plan Acceptance Policies

Due to the tremendous increase in plan/permit applications we will no longer be accepting piecemeal plan revisions.  All revisions must be submitted as part of a complete application package unless specifically otherwise agreed and allowed by the reviewer.  Piecemeal applications will no longer be accepted and could lead to the project being withdrawn if the complete set is not submitted by the due date.

Also, please note that any changes to the NOI throughout the approval process must be either re-notarized with the applicant’s signature or initialed by the designer who is listed as the contact on the certification page of the NOI (page 11).  Please be sure that the NOI is separate from bound narratives as they must be taken out and sent to DEP separately and not as part of a bound narrative.
